|
The Insolvency and Bankruptcy Code (IBC) has completed a successful 5-year journey since enactment. The Code, a transformational piece of legislation, has undergone various amendments in a short span of time. This reflects the responsiveness of the government to balance out business with the economics and make the Code efficient. These changes are in the line with improving the ease of doing business in India and improving recovery rates under the Code.

Since the Code came into effect in 2016, the Corporate Insolvency Resolution Process has commenced for 4,376 companies. Of these, the process has successfully concluded for 2653 companies. Of the CIRPS closed, 617 have been closed on appeal or review or settled; 411 have been withdrawn; and 348 have ended in approval of the resolution plan, till March 2021.

The government has been pro-active towards addressing concerns that have emanated due to the pandemic. Several measures have been announced to address the Non-Performing Assets of banks, including the launch of pre-packaged insolvency resolution plans for MSMEs and the setting up of a Bad Bank for stressed assets. A combination of these initiatives is making the Indian stressed assets sector even more attractive for investors around the world.
